GENERAL CONDITIONS OF CONTRACT

CHARACTER OF THE CONTRACT

These contracting conditions apply to the sale of products on the website of Agro de Bazán, S.A. The language of these conditions is Spanish. These contracting conditions are written in accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, by which the consolidated text of the General Law for the Defense of Consumers and Users is approved and will have force of contract between the parties that have accepted.

The service provider is Agro de Bazán, S.A (hereinafter Agro de Bazán) with address for the purposes of notifications in Lugar de Tremoedo 46, 36628, Vilanova de Arousa, Pontevedra, and Tax Identification Number A-36034668.

CONTENTS AND INFORMATION PROVIDED ON THE PAGE

AGRO DE BAZÁN reserves the right to modify the commercial offer presented on its page (modifications on products, prices, promotions and any other condition of the products and services offered) at any time.

AGRO DE BAZÁN does all the effort possible to its means to offer accurate information and no typographical errors in the website.

In the event that an error of this type occurs, certainly not upon intended by AGRO DE BAZÁN, it would be immediately corrected. If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on that error, AGRO DE BAZÁN will notify the client of such error, and the customer will have the right to rescind his purchase without any cost on his part.

The contents of the website www.bodegasgranbazan.com could, under certain circumstances, show temporary information about some products. In the event that the information provided does not correspond to the characteristics of the product, the customer will have the right to rescind his purchase without any cost on his part.

HOW CAN I PLACE AN ORDER?

To place an order you must be over 18 years old. You can place an order by

• Your user account as a registered user
• As a guest without registration

The user, regardless of the system he adopts, can navigate between the different products and select the one he wants by adding it to his shopping cart. You can add as many different products or units of the same product as you want.

Once you want to finish the purchase you must click on the corresponding option and you can make the payment without being registered or through the registered user data.

Before executing the payment the user will be able to see the final and complete cost of his order, which will be sent to his email once the order is processed.

Once you have made the payment you will receive an email of purchase confirmation with a summary of the order and the conditions of sale.

Within the legitimate interest of the seller we can inform you about the incidents related to your order through the means of contact provided, including the instant messaging services.

In the event that the user chooses to cancel notifications by electronic means, they may stop receiving important notifications regarding their order, and Agro de Bazán is not responsible for delays in delivery due to such circumstances.

AVAILABILITY OF PRODUCTS

AGRO DE BAZÁN guarantees its customers the availability and delivery time of the products offered on its website. All products are subject to stock limits.

If any product is not available once the order is placed, we will inform you as soon as possible. In this case, you can cancel your purchase and the total amount will be returned by the same payment method.

The price of the products will be the one stipulated at all times on our website.

GEOGRAPHICAL LIMIT

Agro de Bazán only sends its products to the Peninsula and the Balearic Islands. Any order received that is addressed in other geographical location will be automatically cancelled. The user will receive a notification indicating their cancellation.

VALUE ADDED TAX

The prices of the products displayed on the website www.agrodebazan.com,  include Value Added Tax (VAT).

Purchases to be delivered within the territory of any of the member states of the European Union will be subject to VAT.

PAYMENT METHOD

When placing the order, the customer can choose to pay for purchases made through a payment gateway that accepts payment by debit / credit card.

EXPENSES, ASPECT AND SHIPPING TERMS

The shipping costs applied to our orders are always 9 euros, except for the orders over 6 bottles. For the last ones, shipping costs are included for orders destined within the peninsula.

All orders will be delivered within one to four business days from the moment of purchase.

The shipment is made through Dachser although for being on time and for logistical reasons another service can be hired. When you receive the summary of your purchase, you will be notified so you can check the status of your shipment.

Delivery will take place at the address indicated at the time of purchase. If the recipient is not found at that time, a notice will be left so that you can pick it up at the post office closest to your home.

Agro de Bazan sends your orders in a package specially designed to protect your products during the transportation and to minimize the possibility of accidents and damages. In addition, all our shipments are guaranteed and have insurance against the loss or breakage.

PRODUCT RETURN GUARANTEE

In the event of possible damage during transport, AGRO DE BAZÁN is responsible for recovering and preparing  a new shipment immediately.

We offer also the possibility of returning or replacing part or all of your order in the event that the product received is not in a good condition.

In case of return because the product has manufacturing defects, AGRO DE BAZÁN will also bear the shipping costs. In these cases the customer will have 30 calendar days to proceed with the return of the product.

The customer can return any item that has been purchased in our store, as long as the products have not any damage and have not been used.

In these cases, AGRO DE BAZÁN, will refund the purchase money through the same means of payment or through a credit to the user’s account through its credits. You can also, if you prefer, receive a new product at no cost.

If a product other than the one requested by the customer was delivered by mistake of AGRO DE BAZÁN, the correct product will be delivered without any additional charge to the buyer. AGRO DE BAZÁN, assumes all transport costs, of the return and of the new shipment.

AGRO DE BAZÁN is not responsible for the misuse or manipulation of the product by the customer. In this case AGRO DE BAZÁN, is not responsible for it and will not proceed to its return.

RIGHT OF WITHDRAWAL

In case the order does not meet your expectations, you have 14 calendar days to return your order at no cost to you, except for the return costs that will be carried by the customer. You can exercise this right through our form by clicking here.

CUSTOMER OBLIGATIONS

The customer agrees at all times to provide truthful information about the data requested in the registration forms or making the order, and keep them updated at all times and keep diligently also passwords provided to you for access to the website.

The customer agrees to accept all terms and conditions contained in these Terms of Use that reflect the best possible service for the type of activity performed by Agro de Bazán.

The customer commits to enable the delivery of the requested order by providing a delivery address where the order can be delivered within the usual schedule of delivery of goods (Monday to Friday from 09:00 to 14:00 and from 16: 00 to 19:00) or the schedule specified by the courier company in your case. In case of breach of this obligation by the customer, AGRO DE BAZÁN will not have any responsibility for the delay or impossibility of delivery of the order requested by the client.

All online payment operations are carried out through a secure server, based on the standard SSL that protects the data against attempted violations by third parties. The data of the purchase process is stored in a database designed for this purpose.

The purchase data, in compliance with Spanish legislation, will be kept for at least five years so it cannot be deleted or rectified even if the client requests so.

LAW AND JURISDICTION

The applicable legislation to resolve any conflict regarding the interpretation of these conditions is the Spanish legislation, as well as the International Treaties that Spain has signed.

The parties submit, at their option, for the resolution of conflicts and waive any other jurisdiction, to the courts and tribunals of the user’s domicile.
